FLORIDA JUDGE ORDERS CHULA VISTA WOMAN AND OTHER WEBSITES
TO REMOVE CON ARTIST EXPOSES
 
Sarasota Circuit Judge Robert B. Bennett Jr. yesterday ordered a Chula Vista, California woman to take down her blog in which she exposed her ex-husband, who she believes is a con artist.
 
Websites across the country had already posted exposes of the man, Phil Haberman, of Sarasota, Florida, who falsely claimed to be a Special Forces soldier and falsely claimed to be wounded in Iraq. The judge ordered the woman, Kristen Rhoad, to "remove or cause to be removed all blogs, e-mails, or other web-based communications to petitioner or third parties that refer to petitioner and which are posted or caused to be posted by respondent." (Rhoad is the respondent.)
 
My website, Lovefraud.com (based in Atlantic City, New Jersey), was one of the websites named in Haberman's petition.

Before he shipped out to Iraq, Haberman hastily married Rhoad, who then lived in Las Vegas Nevada, apparently so he could claim additional money from the military. He served there approximately 24 days before the military realized he was a problem and sent him back to the US.
 
Rhoad alleges that Haberman wiped her out financially, and tried to murder her. In the meantime, he continued to search for more women to victimize through online dating sites.
 
Now divorced, Rhoad has initiated her blog to warn people about Haberman's character and lies.

Haberman filed domestic violence charges against Rhoad and accused her of cyberstalking. He claimed he feared for his life, even though Rhoad lives in California and Haberman (the so-called Special Forces vet) is in Florida.
 
Rhoad was in Sarasota County Florida court yesterday (Sept. 7, 2006) and the judge issued the restraining order against her.  Rhoad claims Haberman's petition for the restraining order contained 39 lies - but the judge refused to allow her to present any evidence. The detective who filed the cyberstalking charges testified based on hearsay, which the judge allowed.
 
The judge said in court that Rhoad might be protected under the First Amendment, but he still found her guilty of cyberstalking.
 
Sarasota Domestic Violence advocates, who accompanied Rhoad to court, were shocked.
 
The judge has ordered Rhoad to remove her blog. Furthermore, he ordered that information on other websites and blogs about Haberman also be removed. If all the websites and blogs did not comply, the judge said he would hold Rhoad responsible and put her in jail for 6 months. He also said he would extradite her from California to do it.

Haberman has a criminal record with offenses from Florida to Massachusetts to Canada. He received two other-than-honorable discharges from the military. Military investigators found that he received $17,000 in excess
payments - in part by claiming Key West, Florida as his address when he did  not live there. They considered it petty theft and declined to prosecute. Haberman was also found guilty of defrauding a Georgia woman of $5,500 while
still married to Rhoad.
 
Sociopaths are experts at manipulating the legal system to their own ends. I believe that is what is happening here.  The victim gets accused, and the predator gets exonerated.

I FINALLY escaped Fayettehell , NC , and am back in sunny South Florida . I was stuck there for the past 2 years healing up from getting hurt in Iraq . Since I am finally back to Florida after so long, I really dont know people down here anymore. I dont go out much and really dont have anyone to do anything with. So I am pretty much relegated to sitting at home alone with my dog Jake. Id love to find people to do things with. Im not a drinker or partier, and unlike most of the guys here in this town, I dont sleep with anything that moves. Im single and very selective about whom I spend time with. I have been called "too good to be true", "too nice of a person",and the famous "like the big brother I never had." Why cant I finally be called the person that someone has waited their whole life to meet? I lost my fiance to breast cancer in July 2000, and value life and what is has to offer. I can be found all over the place at any given time. I just came off active duty, and now work with State and Federal Law Enforcement agencies providing tactical underwater search and rescue solutions to their dive teams. I also work with military Special Operations units and their dive teams as well. Im still in the reserves. In the past, I have done a lot of things. I spent 3 years working on a very well known TV series in California , and I did 3 SAG feature films as well. Ive been lucky enough to work with animals of all kinds, as you can see by my pics. My need for speed has been fed many times from freefalling through the sky to driving an Indy car at almost 200mph. I love to travel, and would LOVE to have a travel partner in crime. She spotted her blind date right away: the clean-cut guy in the black T-shirt that said Special Forces.

Kristen Rhoad had first come into contact with Phil Haberman on Match.com in December 2003. One screen name he favored was 19thSFguy--an allusion to his role in Army Special Forces. A self-described adrenaline junkie who loved everything from "skydiving to swimming with sharks," Haberman listed his income as $50,000 to $75,000 a year and claimed he didn't party, smoke or drink.

He sounded honorable, manly, stable.

Everything that Rhoad, 38 and between jobs, was looking for--and everything that had eluded her so far in serious relationships. Rhoad worked as a legal secretary in Las Vegas to support herself and her 13-year-old daughter Heather. When times were lean, though, like they were now, Rhoad resorted to waiting tables or dancing as "Sedona" at a strip club.

Soon after they met in a casino restaurant, Rhoad and Haberman were chatting like best friends. Haberman, born and raised in Dallas, said he rarely talked to his family "because they didn't believe anything he said." His new home was Key West.

Haberman said he'd joined the Marines in 1989 but had been forced to leave in 1998 after a diving accident almost cost him his life. After his recovery, Haberman said, he'd joined Army Special Forces and was now a sniper and a crypto-linguist, trained in technology to decipher foreign languages.

Listening to his military exploits, Rhoad felt drawn to Haberman, then 31. Short, with big brown eyes and crew-cut brown hair, the soldier had a teddy-bearish quality but carried himself with confidence.

"He asked me what I wanted to do with my life--what my living situation was with my daughter, how long I had been divorced," Rhoad says. Haberman didn't ask her income, but quizzed her about other things: Did she own a house? Was it well-furnished? What about a boat?

When Rhoad said that she lived in a townhouse in a gated community and had two dogs, Haberman's eyes turned pleading. He'd volunteered to go to Iraq, and his dog Jake, a rare Dogo Argentino, needed a place to live while he was gone. "I'd be willing to pay you," Haberman said. Rhoad agreed to take Jake. It was the least she could do for a soldier going to war.

Days later, both Jake and Haberman had moved into her townhouse.

After about a month, an excited Haberman announced he had orders to report to Fort Bragg for training and deployment to Iraq. "He said, 'Let's get married,'" Rhoad says. He'd send her money for rent, plus she'd get military spouse benefits.

"I thought I was in love with him," Rhoad says. "He made me believe everything was perfect, he was going to take care of me."

Hours after they exchanged vows on January 10, 2004, at the Las Vegas courthouse, Haberman piled his belongings into his car. Rhoad was terrified for her new husband, but Haberman viewed it as his job to personally exterminate all the terrorists. As he headed off to North Carolina, Haberman promised to send her dead Iraqis' ears on a string.

Their hasty marriage, however, quickly hit the rocks. By March, when Haberman shipped out to Iraq, they were constantly fighting. Then in April, Rhoad got a call from Haberman, at a hospital in Germany. He said he'd gotten "blown up" by a rocket-propelled grenade while riding in a convoy. His leg and intestines were "messed up bad." Rhoad had been ready to end the marriage but felt she had to stand beside him.

For more than a year now, Haberman has been at Womack Medical Center at Fort Bragg on "medical hold" while undergoing treatment. He sports a Purple Heart "Combat Wounded" ribbon on the bumper of his car. In May 2004, WFAA-Channel 8 aired a story about wounded Special Forces soldier Haberman visiting the journalism class at his alma mater, Richardson High School. He'd written a series of stories about the war for the paper, which inspired the class to collect items to send to troops in Iraq.

Rhoad now believes Haberman married her to get increased benefits as a married soldier, though he kept most of the money for himself. Then Rhoad began to wonder: Was Haberman really in Special Forces? Was he really wounded in Iraq?

Because of privacy laws, confirming that a soldier was wounded in combat is difficult. When the Dallas Observer asked Haberman for permission to obtain his full military record, he refused. "I'm not going to have any feeling in my abdomen or in my left foot for the rest of my life!" Haberman snapped. "I didn't pay the ultimate price, but there are guys in my unit who did pay the ultimate price. This is an insult to them!"

A high-ranking officer who'd befriended Haberman called to defend him. "This is a witch hunt," said the officer, who asked not to be identified. A month later he was calling Haberman "full of half-truths."

Haberman, enraged that anyone would question his military credentials, nonetheless agreed to an interview on base at Fort Bragg, home of the 82nd Airborne and the Army Special Operations Command. Now seeking an annulment of their marriage, Haberman claims Rhoad is an "ID card chaser"--a woman who marries a soldier just for benefits--out to ruin his military career. He insists his job now is to "heal up" so he can return to fight in Iraq.

"They were going to retire me from the military," Haberman says. "I told them I did not want to get out. I love being in special operations."

Trying to find out more about the man she married, Rhoad learned that Jake had made the rounds, helping Haberman get sympathy, money and affection from a string of women. He's lied about his rank, about his role with Special Forces and about what happened to him in Iraq, where he served less than a month. Haberman claims he's been granted the Purple Heart; if so, it was for a bad fall on his butt. .... (there is MUCH more to this article)

These documents were submitted to Las Vegas District Court as evidence in the annulment proceeding mentioned in the Whitley article. He reportedly has numerous criminal records in Virginia , Florida , Montana , and Massachusetts

Phil Haberman convinced a woman to marry him before he left for Iraq . He then abandoned his wife of 10 minutes on the courthouse steps so he could spend time with another woman before deployment. After less than a month Haberman was back in the US , claiming war injuries that other soldiers say never happened.

In the meantime, Haberman claimed Army benefits for being a married spouse, even after allegedly assaulting his wife. The Army found he received $17,000 in excess payments, but declined to prosecute him for "petty theft."

Phil Haberman doesn't like his profile on Lovefraud.com. Lovefraud wrote that his claims of serving in the Special Forces and suffering injuries in Iraq are bogus. We also published his ex-wife's opinion that he married her just to get more money out of the military. Haberman got an other- than-honorale discharge last October.

So what's Haberman doing now? He's looking for dates on MySpace.com. His profile says he was injured in Iraq , he's still in the Army Reserves, and he works with Special Forces dive teams. Will anyone take a chance on a nice guy?

Despite laws against it, thousands wear unearned medals

Early last year, a man claiming to be a Special Forces soldier in transit at McCarran International Airport called the Review-Journal requesting help in getting back a laptop computer that he said had been stolen while he waited for a plane. The computer, he said, contained secret military information and he was in desperate need to replace it.

No help was offered, but a couple months later the Review-Journal was directed to a Web site that contained a profile of the same man, Phil Haberman, a self-described injured soldier who had served in Iraq.

When asked about his Special Forces career in a June 21 telephone conversation, Haberman, a former National Guard soldier who had hop-scotched from units in Nevada, California, Utah and North Carolina, declined to elaborate on his military career.

In a voice mail left later that evening, Haberman said, "Something's not sitting too well with me. ... I would appreciate it if you just leave everything be and not contact anybody in the military about me. ... Again, do not contact anybody in my group and don't track down my former command sergeant major. If it is about the computer or if you have anything you need to speak to me about, you can go through my attorney."

Military records show Haberman was allowed to join the Nevada National Guard even though he had received an other-than-honorable discharge from the Marine Corps.

The Dallas Observer reported last year that Haberman sported a Purple Heart "Combat Wounded" ribbon on the bumper of his car. Haberman went to high school near Dallas, according to the newspaper.

Court papers filed with Family Court in Las Vegas, where his marriage with Kristen Rhoad was annulled, show that Haberman sought a Purple Heart medal. But a Freedom of Information Act request she filed seeking documentation was returned with a message from an Army captain, stating, "Mr. Haberman was not awarded the Purple Heart."

The same captain told Rhoad in another e-mail that Haberman was discharged from the Army on Oct. 26 with an other-than-honorable status.

"Your husband was discharged from the Army yesterday, as well as from the North Carolina National Guard. ... His time in the Army is over. Perhaps he'll try the Air Force next."

Haberman last week could not provide a copy of his discharge papers or his military record to the Review-Journal…..

I dont know the number to my commanding officer because I am on Reserve status. And why do you want to contact and speak with him anyways? I only go to the unit once a month as Im supposed to for drills. …. I just wish you would stop for a minute and hear what I hav to say before passing the judgement that you seem to be passing on me. I would like to report a phony who claims to be Army Special Forces but not a POW.  I found this website so I thought I would share my story.  His name is Phil Haberman and now resides at Fort Bragg, NC.  If you go on-line, and type his name in Yahoo search, an article from the Dallas Obersver will appear.  It is tittled "GI JERK".  Please read it and it will provide you with a lot of information.

… However, he always talked about special forces.  He even told me he spent 11 years in Force Recon in the Marines and he joined Army Special Forces to become a communications sergeant but he said he was not done with all of his schools .  Every time you see him, he wears T-Shirts and such with the Army special Forces Arrowhead, patches, etc.  ….. his license plate even says Army Special Forces.

I don't know if you have been given his name, but please read the article and expose him for what he is.

I would suggest that you rethink your posting on me on your website. As you can see by the date of issue on my ID card, Im still in the military

Ask him for his "other than honorable" discharge paper from his last stint.  If he can't remember where it is, remind him he told me it was locked up in a fireproof box for safe keeping.  Only he knows the combination and that's difficult for any one with short term memory loss to recall.   Bill and I just laugh when we talk about lonesome Phil.  He's a piece of work.   And his seargent major's name is what?

…. checked out his MY Space lies - soooo he lost his fiancée to breast cancer in 2000 …. The picture he has is old - at least 7 years - it's the same one he had posted on match.com years ago….    As far as having no friends in FL - Key West is small and he is known as a liar and a thief - from what I understand if he steps foot back down there he is a dead man - he owes alot of money to alot of "good" people who were just being kind and were suckered in by him.

I am surprised Phil is not in jail.

While at Fort Bragg, Phil introduced himself to xxxxxxxxxxxxx, the commander of A Company at the time.  Phil advertised himself to xxxxxx as a Special Forces trained Sniper and xxxxxxxx was so impressed with his supposed credentials that xxxxxxx demanded I have him assigned to A company …...  While observing him during sniper training, it became very clear that Phil did not have the credentials that he had so adamantly advertised. 

It didn’t take more than 48 hours before xxxxx s ask that I reassign him to another unit.  Subsequently, he was reassigned to the HHC.  I do not recall his initial assignment in HHC; however his shenanigans prompted me to become concerned for his safety and the safety of those around him.  I counseled Phil in a formal counseling session that he had one final chance at rehabilitation.  Phil placed so much self-importance on himself that he did not want to realize that every soldier was important and that we all had a mission to perform.  I recommended to the HHC commander that we place him with the cooks, not as punishment, but as a chance to rehabilitate Phil. 

The mess sergeant had advanced degrees in psychology and criminology, and taught and trained classes for the Dept of Homeland Security and as a university professor.  He had a knack for rehabilitating soldiers and this was why we assigned him to the mess section. His disdain with the 30th Brigade and being around "normal" troops is unfounded. The majority of our soldiers are drawn from prior service soldiers of the 82 Airborne, the Marine units at Camp Lejune and Special Forces and Marine Recon of both Fort Bragg and Camp Lejune.  The unit had deployed to NTC and JRTC, to major training events, in under 12 months.  Not many active duty units can lay claim to this type of preparedness. 

Additionally, our brigade was the only one to operate independently as a Brigade Combat Team and I am told we are the buzz around water coolers at the Pentagon.  It is unfortunate that he didn’t open his eyes to the obvious- we are a premier unit.

Additionally, there is no R.S. Smith.  I spoke with the actual convoy commander this weekend for that particular mission to Balad.  I did not recall any significant event occurring during that time period.  He was never injured on that convoy not did he receive any wounds relating to that incident. 

Phil was supposed to be at drill this past weekend.  He was AWOL.

Phil Haberman, who as far as I know received an "other than honorable" discharge on October 26, 2005, claims he is still in the military…..  By the way, when I last spoke to him in February, he said he was in the military at that time.  The issue date on this card is May 30, 2006. Does that mean he's joined another unit?

To shed some light on this issue, I really don’t know how Haberman obtained a military ID from Macdill AFB.  What I can tell you is that:

1. He was discharged from the U.S. Army with a type of discharge that would make re-entry into the federal Army difficult;

2. He was reduced to PV1 upon discharge;

3. He has been barred from the confines of Ft. Bragg.  If he is caught re-entering, he’ll be arrested;

4. I have witnessed him wearing unauthorized badges and tabs, crimes for which (among others) he was eventually discharged from service;

5. He received a similar discharge from the USMC, Camp Pendleton, CA;

6. He has a DD214 that he obtained when he left service at Bragg that clearly shows his dates of service and type of discharge received;

7. The referenced note from CPT Kaske, a military attorney at the XVIIIth Airborne Corps at Ft. Bragg, simply refers to a fact regarding a housing dispute with his wife and is no legal basis for proving his continued service in the Army;

8. He did serve with a special forces unit in the Utah National Guard, but was kicked out and told never to return ( I talked personally to the unit sergeant major who confirms this);

9. He is not special forces qualified, never having attended the qualification course;

10. Is not authorized to wear the green beret;

11. He was removed from his infantry squad with the North Carolina National Guard while in Iraq and made a cook because his chain of command doubted his ‘mental faculties’ could hold up with him serving as a combat soldier. Again, I confirmed this with Haberman’s company commander overseas;

12. He claims to have been wounded through enemy action in Iraq, a claim which I confirmed to be bogus.  Again, confirmation with the other soldiers he served with in Iraq is a powerful thing.

I write this not out of vindictiveness, but because everything I see Haberman write is predicated upon the infamiliarity of others with the military, and folks’ good-natured support of our military.  He discusses a DD1172, DA 4187 and other documents which are not official documents proving anything; they are simply documents that confirm that he either requested or applied for some benefit that may have been (and usually were) denied.

I was surprised to have read an article on him. I was warned that Haberman was crazy before he was assigned to my unit. He did not sustain any type of injuries that I know of in Iraq. ……. I told him to go and report to the medics on the base we were at. The next thing I know he was going back to Balad to be tested further. That was the last time I have seen

him. I am surprised the Army took so long to discharge him. He really has mental problems and needs to be in a mental institution. For me less than Honorable discharge is better than the Army giving him a medical discharge.

….at Ft. Bragg prior to his deployment to Iraq , and I am sure we could share some stories. At last I heard he is at Ft. Bragg right now for physc eval. I wish I could warn the world about him before some gets hurt again….

….He is still running the same scam - the basis of how he operates is still the same - fiancee' died, being deployed - need someone to watch my dog, injured during a "special forces" diving operation, wounded in Iraq, the military messed up my pay - can I borrow $$$ - the check is coming, can you cash a check for me, can you open a bank account for me because my info is "classified", I am a club dj that worked in NY,  etc etc etc.  The list goes on and on.  he has impersonated active duty military for many years and wears the same "special forces" insignia t shirts - they can be bought on ebay at the exchage etc, or as I said earlier he would sweet talk the clerks and say he forgot his ID or another famous line was "cmon...you know me"  especially at MCRD.  The wording he used on his my space profile is very very similiar to the wording he has used for the past 6 or 7 years on various dating sites…..

…… Haberman went to the SF Qualification Course, but never completed the training.  He was relieved due to disciplinary action.  He was also known to have appeared on a televised game show in Marine Corps uniform as an E-5 (he was an E-3 at the time).  Haberman was at Ft. Bragg for a time, but was sent home, I am not sure why.  He left the Utah Guard for Idaho we think.  He is not thought of very highly by the Special Forces guys here in Utah.
